PREAMBLE

The present terms and conditions (hereinafter referred to as "GTC") are concluded between :

  • on the one hand, the company OLYMPIQUE LYONNAIS, a simplified joint stock company with a capital of €93,511,568 registered in the Lyon Trade and Companies Register under number 385 071 881, whose registered office is at 10 Avenue Simone Veil - 69510 DECINES CHARPIEU, (hereinafter referred to as the "Official Olympique Lyonnais Boutique"), telephone number 08 92 69 69 69 and,
  • on the other hand, any consumer, as defined by French law and jurisprudence, acting exclusively on his own behalf, (hereinafter the "Customer") who wishes to make a distance purchase of one or more items via the website http://boutique.ol.fr (hereinafter the "Site").

The parties agree that the GTC shall exclusively govern their relationship. The Customer has the option of printing the GTC and consulting them at any time on the Site.

In accordance with article 2.7 below, the Customer will receive an attachment of these GTC in a confirmation email following his/her order.

The Official Olympique Lyonnais Store reserves the right to adapt, modify or update the GTC at any time. The GTC in force on the day the order is placed will be applied to each order.

If a condition is missing, it will be considered to be governed by the practices in force in the distance selling sector whose companies are based in France.

ARTICLE 1: PURPOSE

The purpose of the GTC is to define the rights and obligations of the parties in the context of the online sale of products offered on the Site by the Official Olympique Lyonnais Store to the Client.

ARTICLE 2: ORDERING

The order is placed exclusively on the Site after the completion of the following four successive steps:

2.1 Selection of items

After having clicked on the "Add to cart" icon and after having verified and, if necessary, modified the specificities of his/her order (item, quantity, size, colour, price, etc.) from the references of the offers visible on the Site, the Customer validates the choice of the selected item(s) by clicking on the "Order" icon. Information on the availability of the item(s) is given when the order is placed.

2.2 Identification

If the Customer already has an Olweb account, he/she shall fill in the fields provided for this purpose in order to identify himself/herself on the Site by indicating his/her identifier (pseudo) and his/her personal password.

Otherwise, the Client may :

  • follow a registration procedure enabling him to obtain an Olweb account.
  • or connect using their Facebook account (via facebook connect)
  • or order "without an Olweb account" by using the form provided for this purpose at the time of ordering

2.3 Validation

Before validating the order, the Customer has the possibility to check the details and the total price of the order and to correct any errors before confirming its acceptance.

In order for the order to be validated, the Customer must accept the GTC, by clicking in the area indicated. They must also choose the address and delivery method, and finally validate the payment method.

After accessing a summary and choosing the method of payment, the Customer will validate the order by clicking on the "Pay and finalise my order" button.

2.4 Payment

After confirming the content of the order, the Customer will validate it definitively by payment. The order will only be final once the corresponding price has been paid. The means of payment currently accepted are : Carte Bleue, VISA, MASTERCARD, PAYPAL, Cheque (in metropolitan France only) and OL Gift Card.

In order to ensure the security of payments made online, the Website uses the secure payment services of CM-CICpaiement. These services integrate the SSL (Secure Socket Layer) security standard. The confidential data (the 16-digit bank card number, the expiry date and the cryptogram) are directly transmitted encrypted on the SIPS server without passing through the physical media of the Olympique Lyonnais server.

When the bank details are validated, the secure telepayment manager sends an authorisation request to the bank card network. The telepayment manager issues an electronic certificate. The electronic certificate issued by the telepayment manager will be considered as proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 and following of the French Civil Code, as well as the electronic archiving means set up by the Official Olympique Lyonnais Store. In this respect, the dates and times of the server shall be deemed authentic between the parties.

The Customer guarantees that he/she is fully entitled to use the payment card provided for the payment of his/her order and that this card gives access to sufficient funds to cover all costs resulting from this order.

For any payment by cheque, the Customer has 30 days to make the payment by sending the cheque to the order of Olympique Lyonnais. After this period, the order will be automatically cancelled.

In all cases, the payment of the order is equivalent to the signature and express acceptance of the sale, including its price. The Official Lyonnais Store will acknowledge receipt of the order as soon as it is validated by e-mail or by any other means at its convenience.

2.5 Refusal of an order

The Official Lyonnais Store reserves the right to suspend all order processing and delivery in the event of refusal of authorisation of payment by credit card by officially accredited organisations or in the event of non-payment. The Official Olympique Lyonnais Store reserves the right to refuse to make a delivery or to honour an order from a Customer who has not paid in full or in part for a previous order or with whom a payment dispute is being administered.

The Official Olympique Lyonnais Store is a retailer and does not sell large quantities of the products offered. Consequently, the Official Lyonnais Store reserves the right to refuse orders for the same product in large quantities.

2.6 Order tracking

For any question relating to the follow-up of his order, the Customer can call 0892.69.69.69 (0,05€/min) or the N° CRISTAL 09.69.36.05.83 (cost of a local call) from Monday to Saturday from 10am to 7pm (Closed on public holidays).

2.7 Order confirmation

The Customer will receive an order confirmation email within a reasonable period of time after payment of the order and at the latest on the day of delivery.

These GTC, as well as a withdrawal form in accordance with Article L. 221-5 of the French Consumer Code, are attached on a durable medium (PDF) to this confirmation email.

Olympique Lyonnais can in no way be held responsible for a lack of information in the event that the Customer indicates an incorrect email address.

2.8 Pre-ordering

The Customer may pre-order a product on the Site or in OL Boutique Store, an item that is not yet available for sale, in order to reserve it for the day of its release. The pre-ordered item will be delivered to the Customer, according to the delivery method chosen by the Customer.

If, exceptionally, Olympique Lyonnais is unable to deliver the Product, the Customer will be fully reimbursed for the amount paid, by bank transfer [CG1] and at no additional cost.

The date of arrival in stock of the article is indicated to the Customer as an indication, this date is likely to change. Consequently, Olympique Lyonnais cannot be held responsible for any delay in delivery.

The Customer must pay the full price of the item at the time of the pre-order.

ARTICLE 3: DESCRIPTION AND AVAILABILITY OF PRODUCTS

3.1 Availability

The products governed by the GTC are those that appear on the Site. The product offers are valid as long as they are visible on the Site. The products are described and presented as accurately as possible. However, the Official Olympique Lyonnais Store cannot be held responsible for any errors or omissions in this presentation. The photographs of the products are not contractual.

The Official Olympique Lyonnais Store undertakes to honour orders received on the Site only within the limits of available stocks of products. 

In the event of unavailability of an ordered product after the order has been placed, the Customer will be informed as soon as possible by e-mail or telephone and will have the possibility of cancelling the part of the order relating to the said product, the rest of the order remaining firm and definitive. 

The Customer will then have the choice :

  • either to be delivered an article or service of equivalent quality and price, within the limits of available stocks;
  • or to wait for the next delivery, the timeframe of which will be specified;
  • or to be reimbursed for the price of the item ordered within 15 days of his request.

3.2 Personalised products

Products personalised at the Customer's request, such as a "flocked" jersey, may not contain the official name and number of a player who is no longer under contract with the Club at the date of the order. The list of available players can be accessed via the drop-down menu in the product sheet concerned. The Official Olympique Lyonnais Store reserves the right to suspend any order processing and any delivery in the event of an order for a product placed in contradiction with the present article.

ARTICLE 4: PRICES

The prices are indicated in euros including all taxes. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the prices of the products. Similarly, if one or more taxes or contributions, particularly environmental taxes, are created or modified, either upwards or downwards, this change may be passed on to the sale price of the products.

The payment of the totality of the price must be made at the time of the order. At no time may the sums paid be considered as a deposit or advance payment.

The Official Olympique Lyonnais Store reserves the right to modify its prices at any time but undertakes to apply the prices in force at the time of the order, subject to availability on that date.

Prices do not include a flat-rate contribution to the cost of processing the order (postage, packaging and preparation of the parcel) which, unless a special exemption offer is made, will be invoiced to the Customer as an additional charge, and will be indicated before the order is definitively confirmed.

The Customer shall bear the telecommunication costs of accessing the Internet and using the Site, as well as of calls to the numbers indicated in the GTC.

ARTICLE 5: DELIVERY

The Customer must refer to the following address: https://boutique.olweb.fr/fr/content/1-livraison-et-retours to find out about delivery terms, times and costs. The Olympique Lyonnais Store has chosen the SO COLISSIMO and CHRONOPOST services for its deliveries, the terms and conditions of which are presented in the Delivery section of the Site.

5.1. Place of delivery

The items are sent to the delivery address or to the relay point that the Customer has indicated during the ordering process. Packages are delivered to Metropolitan France, Corsica, the French Overseas Territories, and a large number of foreign countries, a complete list of which can be found in the Delivery section of the Website.

The Official Olympique Lyonnais Store shall in no way be held responsible in the event of delay and/or non-delivery due to the address indicated by the Customer and in particular due to a false or erroneous address or one to which delivery would prove impossible.

In the event that the delivery company returns the parcel to the Official Olympique Lyonnais Store, the Customer Service will contact the Customer for a possible reshipment at the Customer's request and expense. If there is no response from the Customer within 30 calendar days, the Official Lyonnais Store will make a refund, except for personalised items.

Conditions specific to SO COLISSIMO :

In the event of a delivery request to an address chosen by the Customer, the parcel will be given to the Customer in person or delivered to the Customer's letterbox. If the Customer is absent at the time of delivery, a delivery notice will be left in the letterbox and the parcel will be made available to the Customer in the post office to which the Customer is attached. The Customer will thus have 10 working days from the arrival of the package at the post office to collect it. After this period, it will be returned to the Official Olympique Lyonnais Store. In all cases, the Customer will be informed by email 24 hours before the delivery of the parcel.

In the event of a collection request from a relay point (for metropolitan France only), the Customer will be informed of the availability of his parcel by SMS and/or email, with a collection voucher allowing him to collect it within 10 working days, on presentation of a valid identity document. After this period, the package will be returned to the Official Olympique Lyonnais Store.

5.2. Delivery time

The delivery of the ordered item(s) will take place at the latest within 30 days from the day following the Order, subject to full payment by the Client of the price for the available items, unless a specific stipulation is indicated to the Client prior to the placing of the order as well as prior to its final validation.

In this case, the Official Olympique Lyonnais Store will provide the Client with an estimated delivery date. This time frame will be indicated as an indication in the Delivery section of the Site. Delivery times cannot be guaranteed in the event of force majeure and in particular in the event of a strike.

For orders including items to be personalised, a maximum preparation time of 24 hours may be necessary. For pre-ordered or out-of-stock products, the delivery time is calculated from the date of availability of the products.

After a period of 6 weeks without any delivery, the Official Olympique Lyonnais Store will propose the cancellation of the order and reimbursement to the Customer.

SO COLISSIMO :

The delivery time is taken into account from the moment the parcel is handed over to the Post Office (count a period of 2 to 6 working days, for metropolitan France, after the order is placed to receive the parcel).

CHRONOPOST :

For all orders placed before 10am, Monday to Friday, delivery is scheduled for the following day before 1pm. Orders placed from Friday 10am to Monday 10am are delivered the following Tuesday before 1pm. This delivery option is only available for orders to be delivered in France.

DELIVERY BY A THIRD PARTY :

The delivery of personalised phone covers is exclusively operated by a third party and is carried out between 2 and 5 working days from the dispatch of the article.

The Customer will not be charged for the delivery of the personalised phone covers. The said shells will be sent by recorded delivery to the home address chosen by the Customer.

In the event that an order includes one or more products from the shop and a personalised shell, delivery will be made in two separate packages.

It is specified that delivery of the boutique products will be offered and limited to one delivery via SOCOLISSIMO domicile. The delivery of personalised hulls will be carried out by recorded delivery without any delivery charges being invoiced to the Client.

5.3. Delivery cost

The Client's contribution to the cost of logistical preparation and shipping is inclusive of all taxes. Details of the costs are indicated in the Delivery section of the Site and on the order summary.

If the Customer lives abroad, the standard amount of the service varies according to the country of delivery and the weight of the parcel. Customs fees (the amount of which depends on the legislation specific to each country) may be requested from the Customer upon delivery. No reimbursement of customs fees is possible.

5.4. Delivery made

Each delivery is deemed to have been made as soon as the item has been handed over to the Customer, in particular by the carrier, as evidenced by the control system used.

The Customer will receive, upon delivery, an invoice detailing the price of each item and the delivery costs charged to the Customer.

The Customer is expressly informed that it is his responsibility, upon delivery of the package, to check its general condition (damage, damaged package, etc.) as well as its contents and to ensure that it conforms to his order (number, etc.). If this is not the case, the Customer must imperatively make his remarks or his express and written reservations on the delivery note under the conditions specified in article 7 below.

ARTICLE 6: RIGHT OF WITHDRAWAL

In accordance with the provisions of article L. 221-18 et seq. of the French Consumer Code, the Customer has a period of 14 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund, by sending Olympique Lyonnais the withdrawal form attached hereto, without having to justify his reasons or pay penalties, with the exception of the cost of return. Only products returned in their entirety, in their original packaging, complete and intact, and in perfect condition for resale will be taken back. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.

After having communicated his decision to withdraw, the Customer has 14 days to send or return the goods. The product must be returned to the seller, whole, not disassembled and in its original packaging, by registered Colissimo, to the address mentioned in article 8.

It is specified that, in the case of a gift, the right of withdrawal remains exclusively with the Customer and cannot be exercised by the recipient of the gift.

Personalised products :

As an exception to the above, and in accordance with the provisions of Article L 221-28 3° of the French Consumer Code, the Customer is hereby informed that the right of withdrawal does not apply to the sale of items personalised at his/her request, such as, for example, a "flocked" jersey with an official player's flock or personalised flock, an "allée des lumières" plate stamped with the Customer's first and last name or personalised telephone covers.

Hygiene products :

As an exception to the above, and in accordance with the provisions of article L 221-28 5° of the French Consumer Code, the Customer is informed that the right of withdrawal does not apply to the sale of items which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection (e.g.: protective mask).

ARTICLE 7: CONFORMITY OF THE PRODUCTS

If at the time of delivery (at home or at a collection point), the original packaging is damaged, torn or open, the Customer must check the condition of the items. If they have been damaged, the Customer must refuse the parcel and note a reservation on the delivery slip (parcel refused because opened or damaged).

In general, the Customer must indicate on the delivery slip, in the form of handwritten reservations accompanied by his/her signature, any non-conformity of the products in kind or in quality in relation to the indications on the order form (such as damage, missing product in relation to the delivery slip, damaged package, broken products, etc.). This verification is considered to have been carried out once the Customer, or a person authorised by him, has signed the delivery note.

The Customer must then confirm these reservations to the carrier by registered mail within two working days following receipt of the item(s) and immediately send a copy of this letter to the Official Olympique Lyonnais Store by email (serviceClient@ol.fr) or by mail (OL CUSTOMER SERVICE - 10 Avenue Simone Veil 69150 Décines France).

Any claim not made in accordance with the rules defined above and within the time limit set shall not be taken into account and shall release the Lyonnais Official Store from any liability towards the Customer.

The Official Olympique Lyonnais Store undertakes to exchange, give a credit note or reimburse the Customer for defective, damaged or spoiled products or products that do not correspond to the Customer's order.

ARTICLE 8: RETURNS

In the event of withdrawal or non-conformity (with the exception of hygiene products such as masks), products that need to be returned to the Official Olympique Lyonnais Store must be returned by the Customer within 15 (fifteen) calendar days of the date of receipt of the order, and under the following conditions :

  • in their original packaging ;
  • complete (accessories, instructions, etc.)
  • clean and not worn;
  • neither damaged nor deteriorated;
  • accompanied by the corresponding original invoice.

In the case of a return for non-conformity, the Customer must also attach the reasons for the alleged non-conformity to the package. Items that are not returned within the time limits and under the conditions mentioned above will not be reimbursed or exchanged by the Official Store.

In particular, any item returned damaged, spoiled, incomplete or soiled and which has not been the subject of remarks or express reservations in writing by the Customer upon collection or receipt by the carrier will be refused by the Official Lyonnais Store and will therefore not give rise to an exchange or refund.

Returns must be sent to the following address

OL CUSTOMER SERVICE - RETURNS 10 Avenue Simone Veil 69150 DECINES CHARPIEU FRANCE.

In case of exercising the right of retraction, the return costs are at the Customer's charge. For better security, it is advisable to send the return package by registered mail with return receipt or by any other means allowing the package to be tracked.

In the event of non-conformity of the item(s), the costs of return shipping by the Customer are borne by the Official Olympique Lyonnais Store.  The Customer must contact the customer service number CRISTAL 09.69.36.05.83 (cost of a local call), so that a re-shipment label can be sent to him.

ARTICLE 9 : REFUND

In the event of withdrawal, duly justified non-conformity or cancellation of the order due to unavailability, the Official Olympique Lyonnais Store undertakes to reimburse the sums collected within fourteen (14) working days by crediting the Customer's bank account corresponding to the bank card used for payment or by bank transfer.

However, the Official Olympique Lyonnais Store reserves the right to defer reimbursement in the following cases

  • until receipt of the goods in their entirety;
  • until receipt of a proof of shipment of the entire good (mentioning the sender, the recipient and the product shipped)

If, when ordering, the Customer has benefited from a promotional advantage such as the granting of a discount, he will be reimbursed at the price he actually paid.

In the event of a promotional offer involving several products, the Official Olympique Lyonnais Store reserves the right to demand the return of all the products constituting the promotional offer concerned in the event of a request for reimbursement.

In the event of a new order, if the new order is for a higher amount, the Customer must enclose payment for the balance with the exchange request.

Conversely, if the amount of the exchange is less than the initial amount, the Customer will receive a credit note in the form of a code for reimbursement of the difference upon receipt of the request. The said credit note must be used within twelve months of its issue; after this period, the use or reimbursement of this credit note may not be demanded by the Customer, for any reason whatsoever.

ARTICLE 10: LIABILITY AND GUARANTEES

10.1. In accordance with the regulations in force, the Official Olympique Lyonnais Store undertakes to respect its legal obligations relating to the guarantees attached to the items sold on the Site and which are set out in articles L. 217-4 to L. 217-13 of the French Consumer Code and articles 1641, 1648 and 2232 of the French Civil Code.

When the CUSTOMER acts under the legal guarantee of conformity:
  • He has a period of two years from the delivery of the articles to act;
  • Subject to the cost conditions provided for in Article L211-9 of the French Consumer Code, the CUSTOMER may choose between repairing or replacing the items against the item(s) conforming to the initial Order by returning the item(s), in accordance with the provisions below, within fourteen (14) clear days from receipt of the ordered items,
The CUSTOMER may request a refund of the items in the Order.
  • The CUSTOMER shall not be required to prove the existence of a lack of conformity of the items during the twenty-four months following delivery of the items.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
The CUSTOMER may decide to implement the guarantee against hidden defects of the items sold within the meaning of Article 1641 of the Civil Code.  The CUSTOMER then has the option of either rescinding the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.

It is specified that the guarantees do not apply to the normal wear and tear of certain parts or articles, nor in the case of professional or collective use, nor to damage caused by causes external to the articles.

The Customer is expressly informed that the Official Olympique Lyonnais Store is not the producer of all of the products presented within the meaning of Law No. 98-389 of 19 May 1998 concerning liability for defective products.

10.2. For all stages of access to the Site, consultation, filling in forms, placing orders, delivery of items or any other service, the Official Olympique Lyonnais Store has only an obligation of means.

Consequently, the Lyonnais Official Store cannot be held responsible for any inconvenience or damage inherent to the use of the internet network and totally external to the diligence and precautions taken by the Lyonnais Official Store. In particular, the Official Lyonnais Store cannot be held responsible for any disruption in the supply of the service, or any external intrusion or presence of a computer virus.

10.3. The Lyonnais Official Store shall be responsible for the delivery, as long as the Customer is not in possession of his order in accordance with article L.221-15 of the French Consumer Code.

The Lyonnais Official Store may be exonerated from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

ARTICLE 11: PERSONAL DATA AND COOKIES

11.1. Personal data relating to the Customer collected by the Official Olympique Lyonnais Store is processed in the context of the execution of the present contract in accordance with the provisions of Law no. 8-17 of 6 January 1978, amended by Law no. 2004-801 of 6 August 2004, and the European Regulation on the protection of personal data. They are necessary for the management of the commercial relationship between the parties. The Customer guarantees the accuracy of the information provided and shall be solely responsible for any erroneous, incomplete or obsolete information. Any change of address, name, email or any other identification element that may be necessary for the proper management of the commercial relationship must be notified directly to the Official Lyonnais Store. The latter shall in no way be liable in the event of non-receipt of an offer or benefit due to obsolete or incorrectly filled in information.

11.2. The Official Olympique Lyonnais Store may, with the prior consent of the Customer, use this data in the context of direct marketing operations by sending the Customer, by any means whatsoever and in particular by SMS, e-mail or post:

information on similar products or services or on complementary products or services offered by Olympique Lyonnais Groupe and/or its subsidiaries

commercial offers and advantages from its partners.

At any time, the Customer may exercise his right to object under the above conditions.

11.3 The Official Olympique Lyonnais Store uses tracking technologies, in particular cookies, to adapt advertising to your needs and interests on our sites or those of our partners. You can manage advertising tracking cookies and performance cookies in the "cookie settings" tab of the cookie information panel or indicate at any time your opposition to advertising profiling following receipt of the communications sent to you.

11.4. In accordance with the French "Informatique et Liberté" law in force and the European regulations concerning the protection of personal data, the Customer has the following rights: right of access, right of rectification, right of deletion, right of portability, right of opposition on legitimate grounds, right to limit processing, right to withdraw consent where applicable, right to define directives concerning the fate of his/her personal data in the event of death. These requests may be made by e-mail to dpo@ol.fr or by post to the attention of the DPO of Olympique Lyonnais Groupe, 10 Avenue Simone Veil 69150 Décines Cedex, accompanied by a copy of an identity document.

ARTICLE 12: SPECIFIC CONDITIONS OF SALE APPLICABLE DURING THE SALE

During the annual sale period of the Official Olympique Lyonnais Store, the following special conditions shall apply, in derogation of article 8 of these GTC, the returned products cannot be exchanged but shall be reimbursed under the conditions of article 9. Promotional codes from which the Customer may benefit will not be applicable during the period concerned.

ARTICLE 13: SPECIFIC CONDITIONS FOR THE NAMEPLATES ON THE ALLEE DES LUMIERES

In accordance with the concept known as the "Allée des Lumières" and its price list indicated on the Site http://www.alleedeslumieres.com, Olympique Lyonnais supporters have the possibility of purchasing a name plate placed on the said "Allée des Lumières" at Groupama Stadium. The visuals present on the Website are only given as an indication, as the Official Olympique Lyonnais Store reserves the right to choose the final layout of the plaques and their placement within the chosen zone.

13.1. The order for the name plaque will only be definitively validated after discretionary approval of the personalised content of the plaque (consisting of the first name, surname and, if applicable, the message) by the Official Olympique Lyonnais Store, which may demand any modification of the content and, in the absence of cooperation from the Customer, cancel the order. Content that is prohibited by law or contrary to good morals is prohibited, including, but not limited to, (i) content of a fascist, xenophobic, sexual, racist, sectarian, insulting, humiliating, defamatory or offensive nature, (ii) content that infringes on a person's private life, the honour or consideration of any individual or legal entity, an intellectual property right and/or the image of Olympique Lyonnais. Those using the name of a personality of the club or of an opposing club may also be refused.

The inscriptions on the plaque must not constitute direct or indirect advertising. In particular, the verbal or visual presentation of goods, services, the name, website, brand or activities of a producer of goods or a service provider is prohibited.

13.2 The nameplate cannot be changed or removed after the installation of the nameplate module. 

13.3. The Customer guarantees that he/she is the owner (or in the case of a purchase for a third party, that he/she has valid rights) of the content of the inscriptions on the nameplate (in particular the first and last names) and that he/she is duly authorised to transfer the related rights to the Official Olympique Lyonnais Store for the initial inscription on the nameplate and for reproduction on all present or future operating media, for the entire duration of the nameplate's operation. The Client also expressly agrees that his name may be associated with all brands owned by Olympique Lyonnais and/or its partners (in particular the stadium namer).

13.4. As the nameplate is located in a public place, Olympique Lyonnais cannot be held responsible in the event of damage and/or disappearance. However, Olympique Lyonnais undertakes to make its best efforts to guarantee its presence and maintenance for a period of ten years.

13.5. The Client is aware that the visibility of his name plate may be reserved for the organisation of major events, which would require masking measures within the framework of the provision of the Groupama Stadium.

13.6 The nameplates are positioned randomly in the chosen area. The Client will also not have the choice of the legendary player next to whom his plaque will be installed.

ARTICLE 14: MISCELLANEOUS PROVISIONS

14.1. The GTC express the entirety of the obligations of the parties. No indication, no document can generate obligations under the present terms and conditions, if they are not the subject of an amendment signed by both parties.

14.2 Any tolerance or waiver by either party in the application of all or part of the undertakings provided for in these conditions, however frequent and however long, shall not constitute a modification of this agreement, nor shall it generate any right whatsoever.

Consequently, no delay or inaction, abstention or omission on the part of the Official Olympique Lyonnais Store in exercising any of its rights will prejudice the said right, nor will it be considered as implying a waiver on its part of that right.

14.3 If one or more of the provisions of the GTC are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope.

14.4 Failure by the Client to comply with the obligations under the terms of the GTC, and in particular with regard to any incident of payment of the price of an order, erroneous address or any other problem on the Client's account, may result in the suspension of access to the sales service on the Website, or even the termination of the Client's OL account depending on the degree of seriousness of the actions in question, without prejudice to any damages that the Official Olympique Lyonnais Store may seek.

14.5 In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes: when the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. The mediator must be contacted within one year of the initial complaint.
